Terms of Service — Bin There Before

01 ACCEPTANCE OF TERMS

By accessing or using the website bintherebefore.com, joining our waitlist, signing up for services, or otherwise engaging with Bin There Before LLC ("Company," "we," "us," or "our"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

If you are entering into these Terms on behalf of a Homeowners Association, property management company, or other legal entity, you represent that you have authority to bind that entity, and "you" shall refer to that entity.

If you do not agree to these Terms, do not use our website or services. Your continued use of our platform after any modifications to these Terms constitutes acceptance of those changes.

02 SERVICES DESCRIPTION

Bin There Before LLC provides residential valet trash and recycling services, including but not limited to:

  • Doorstep Valet Service: Collection of trash and/or recycling bins from a resident's front door and return of bins after municipal pickup, offered primarily to HOA communities, condominiums, and apartment complexes.
  • Bin-to-Curb Service: Rolling trash and recycling bins from storage locations to the curb before scheduled municipal pickup and returning bins following pickup.
  • Waitlist Enrollment: A reservation system allowing prospective customers to express interest and secure founding-member pricing in advance of service launch in a given market.
  • HOA Community Contracts: Bulk service agreements entered into with homeowners associations or property management entities covering all or a defined subset of units within a community.

Services are subject to availability by geographic area and minimum enrollment thresholds. We reserve the right to modify, suspend, or discontinue any service offering at any time, with reasonable notice to active customers.

03 SMS & TEXT MESSAGING (A2P)

A2P 10DLC Compliant Messaging Bin There Before sends application-to-person (A2P) text messages via registered 10DLC campaigns. All SMS communications comply with TCPA, CTIA guidelines, and carrier requirements.

3.1 Consent to Receive Text Messages

SMS consent is collected via our opt-in form at bintherebefore.com/reserve-your-spot-dfw and on our website at bintherebefore.com. By providing your mobile phone number and checking the SMS consent checkbox on our opt-in form, joining our waitlist, signing up for service, or otherwise opting in, you expressly consent to receive recurring automated text messages (SMS/MMS) from Bin There Before LLC, including messages sent via an automatic telephone dialing system (ATDS) or using A2P messaging platforms, to the mobile number you provide. Message categories include:

  • Waitlist status updates and market launch notifications
  • Service confirmation and scheduling reminders
  • Weekly pickup reminders and service alerts
  • Account and billing notifications
  • Promotional offers and service announcements (where separately opted in)

3.2 Message Frequency

Message frequency varies. Transactional messages (pickup reminders, confirmations, account notices) may be sent up to 4–6 times per month per active service. Promotional messages will only be sent if you have separately opted into marketing communications. You may receive additional messages around service launch events or changes to your account.

3.3 Message & Data Rates

Message and data rates may apply. Standard text messaging and data rates from your mobile carrier may apply to messages you receive from us. These charges are billed by your carrier and are not controlled by Bin There Before LLC.

3.4 How to Opt Out

You may opt out of receiving text messages from Bin There Before at any time by:

  • Replying STOP to any text message we send you. After opting out, you will receive one final confirmation message and no further messages will be sent, except as required by law.
  • Emailing us at [email protected] with your name and phone number and a written request to unsubscribe from SMS communications.

Note: Opting out of SMS does not cancel your service. To cancel service, see Section 8.

3.5 How to Get Help

For help with SMS communications, reply HELP to any text message we send you, or contact us at [email protected] or the contact information in Section 12. You may also text INFO for program information.

3.6 Supported Carriers

Supported carriers include but are not limited to: AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, Nextel, U.S. Cellular, Cricket, MetroPCS, Virgin Mobile, Google Voice, and other regional carriers. Bin There Before is not liable for delayed or undelivered messages due to carrier issues outside our control.

3.7 No Third-Party Sharing of Opt-In Data

Your phone number and SMS opt-in consent will never be sold, transferred, or shared with any third party for their marketing purposes. Mobile opt-in data and consent information is not shared with third parties under any circumstances. This opt-in data is used solely to deliver the messaging program described herein.

3.8 Consent Not Required for Purchase

Consent to receive text messages is not a condition of purchasing any services from Bin There Before LLC. You may decline to provide a phone number or may opt out of text messages at any time without affecting your eligibility for service.

04 WAITLIST & ACCOUNT REGISTRATION

By joining our waitlist, you represent that:

  • You are at least 18 years of age or the age of majority in your jurisdiction.
  • The information you provide (name, email address, phone number, service address) is accurate and current.
  • You will notify us of any changes to your contact or service address information.

Joining the waitlist does not guarantee service availability, pricing, or launch timing. Waitlist placement is maintained on a first-come, first-served basis per market area. Founding-rate pricing is locked at the time of waitlist enrollment and is subject to availability based on enrollment thresholds.

We reserve the right to remove any user from the waitlist for any reason, including suspected fraud, inaccurate information, or violation of these Terms.

05 BILLING & PAYMENT

When service launches in your area and you activate your subscription:

  • Payment is due monthly in advance. Billing begins on the date your service is activated.
  • Founding-rate pricing is locked for the period specified at enrollment, after which standard rates apply.
  • For HOA community contracts, billing is issued to the HOA or property management entity. Individual residents are not billed separately under community contracts.
  • We accept major credit/debit cards and ACH bank transfers for community accounts.
  • A payment method on file is required to maintain an active account.

Waitlist enrollment does not create a billing obligation. No charges are made until your service is actively confirmed and launched.

06 SERVICE AREAS & AVAILABILITY

Services are currently available in or launching in the Dallas–Fort Worth, TX metropolitan area. Other markets (Houston TX, Austin TX, Charlotte NC, and others) are listed as coming soon and subject to minimum enrollment thresholds before launch.

We make no guarantee as to when or whether service will launch in any particular area. Markets may be added or removed at our sole discretion. Waitlist members will be notified of any material changes to their market's launch status.

07 ACCEPTABLE USE

You agree not to use our services or website to:

  • Provide false or misleading registration information.
  • Attempt to access systems, data, or accounts you are not authorized to access.
  • Interfere with or disrupt the integrity or performance of our platform.
  • Use our service for the disposal of hazardous, biological, chemical, or illegal materials not accepted by municipal waste collection.
  • Attempt to reverse engineer or scrape our website or systems.

Violation of acceptable use policies may result in immediate termination of your account and, where appropriate, referral to law enforcement.

08 CANCELLATION & REFUNDS

You may cancel your service subscription at any time by contacting us at [email protected]. Cancellations are effective at the end of the current billing period; no prorated refunds are issued for partial months except where required by applicable law.

Waitlist enrollment may be cancelled at any time with no penalty, as no charge is made for waitlist enrollment.

HOA community contracts are governed by the specific terms of the executed community agreement. Early termination provisions are specified in that contract.

Missed pickups: If we miss a scheduled pickup through our fault (not due to weather, municipal delays, or access restrictions), we will complete a makeup pickup within 48 hours at no additional charge or credit your account for that pickup.

09 LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BIN THERE BEFORE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES OR WEBSITE.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to Bin There Before LLC in the three (3) months preceding the event giving rise to the claim.

We do not warrant that our website or services will be uninterrupted, error-free, or free of viruses or other harmful components. Services are provided "as is" and "as available."

10 DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.

Before filing any legal claim, you agree to contact us in good faith at [email protected] to attempt to resolve the dispute informally. Most disputes can be resolved quickly through direct communication.

11 CHANGES TO TERMS

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. For material changes, we will provide notice via email or SMS (if you have opted in) at least 14 days prior to the change taking effect.

Your continued use of our services after the effective date of any changes constitutes your acceptance of the updated Terms.
